ONLINE STORE TERMS AND CONDITIONS<\/p>

The owner of the online store www.oohelk.ee (hereinafter referred to as the Online Store) is TAIM O\u00dc (registry code 17066078), located at Kaarna tn 27e Tallinn Harjumaa 12916.<\/p>

Validity of the Sales Agreement, Product and Price Information
These terms and conditions apply to purchases made from the Online Store.
The prices of products sold in the Online Store are indicated next to the products. A delivery fee is added to the price. All prices of goods sold in the online store are in euros.
The delivery fee depends on the buyer’s location and the delivery method. The delivery fee is displayed to the buyer when placing the order.
Information about the goods is provided directly next to the goods in the Online Store.
Placing an Order
Here, the merchant must proceed according to their online store’s purchase completion solution.
To order goods, add the desired products to the shopping cart. To place an order, you must fill in the required data fields and select a suitable product delivery method. Then, the amount payable will be displayed on the screen, which can be paid securely through the following payment methods:
Delete payment methods not used by the online store and add others if additional payment solutions are in use.

* Latvian bank payments: Swedbank, SEB, Citadele, Citadele and Luminor
* Lithuanian bank payments: Swedbank, SEB, Citadele, ?iauliu and Luminor <\/p>

NB! When paying with a bank link, be sure to click the \u201cBack to merchant\u201d button on the bank’s page. <\/p>

Payments are mediated by Montonio Finance UAB. Payment takes place in a secure environment outside the Online Store \u2013 when paying with a bank link, in the secure environment of the respective bank, and when paying with a credit card, in the secure environment of Maksekeskus AS. The seller does not have access to the customer’s bank and credit card details. The agreement enters into force upon receipt of the amount due to the Online Store’s bank account. <\/p>

The owner of the Online Store is the responsible data controller for personal data and transfers the personal data necessary for processing payments to the authorized processor Montonio Finance UAB.
If the ordered goods cannot be delivered due to the goods being out of stock or for any other reason, the buyer will be informed as soon as possible, and the paid money (including delivery costs) will be refunded without delay, but no later than within 14 days of sending the notification.
Delivery
Goods are shipped to the following countries: Estonia, Latvia, Lithuania, Finland, Sweden, Norway, Germany
To pick up the goods, the buyer has the following options: indicate here, for example, the partners of the online store\u2019s parcel machines, courier companies, the option of picking up the goods yourself.
Shipping costs are borne by the buyer, and the corresponding price information is displayed next to the shipping method.
Shipments within Estonia generally reach the destination specified by the buyer within 9 working days from the entry into force of the sales agreement. Outside Estonia, delivery takes place within 20 calendar days.
In exceptional cases, the right to deliver the goods extends up to 45 calendar days.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days. <\/p>

NB! Depending on the products, the buyer may not have the right of withdrawal; in such cases, the relevant products and services must be listed and must comply with the conditions listed in \u00a7 53 (4) of the Law of Obligations Act. <\/p>

The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day right of return, the ordered goods must not be used in any way other than what is necessary to ascertain the nature, characteristics, and functioning of the goods, in a manner permitted for testing goods in a physical store.
If the goods have been used for purposes other than what is necessary to ascertain their nature, characteristics, and functioning, or if they show signs of use or wear, the Online Store has the right to reduce the refund amount in proportion to the decrease in the value of the goods.
To return the goods, a withdrawal application for the purchase of the goods must be submitted and sent to the email address kanela@kanela.ee no later than 14 days from the receipt of the goods.<\/p>

The costs of returning the goods are borne by the buyer, except when the reason for return is that the product to be returned does not match what was ordered (e.g., wrong or defective product).
The buyer must return the goods within 14 days following the submission of the application or provide proof that they have handed over the goods to the carrier within the aforementioned period.
Upon receiving the returned goods, the Online Store will refund all payments received from the buyer under the contract without delay, but no later than 14 days from the receipt of the withdrawal application.
The Online Store may refuse to make refunds until it has received the item that is the subject of the contract or until the buyer has provided proof that they have sent the item back, whichever occurs first.<\/p>

Returns from Outside Estonia (Finland and Other Countries)<\/strong><\/p>

If the buyer wishes to return goods from outside Estonia (e.g., from Finland), they must arrange the return through their country’s postal service and cover all return-related costs themselves.

The online store has the right to withdraw from a sales transaction and demand the return of the goods from the buyer if the price of the goods in the online store is significantly below the market price due to an error.
Right to make a claim<\/p>

The Online Store is responsible for any non-conformity or defect of the goods sold to the buyer that existed at the time of delivery and appears within two years from the delivery of the goods to the buyer. Within this 1 year from the delivery of the item to the buyer, it is presumed that the defect existed at the time of delivery. It is the Online Store’s obligation to refute this presumption. <\/p>

If a defect appears, the buyer has the right to contact the online store within two months at the latest by sending an email to kanela@kanela.ee.
The Online Store is not responsible for defects that have arisen after the goods have been handed over to the buyer.
If goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all payments associated with the sales contract to the buyer. <\/p>

The Online Store will respond to the consumer’s complaint in writing or in a form allowing written reproduction within 15 days.<\/p>

Direct Marketing and Personal Data Processing
The Online Store uses personal data entered by the buyer only for processing the order and sending the goods to the buyer. The Online Store transfers personal data to transport service providers for the purpose of delivering the goods. <\/p>

Dispute Resolution
If the buyer has complaints regarding the Online Store, these must be sent to the email address kanela@kanela.ee<\/p>

If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. You can familiarize yourself with the procedural conditions and submit an application here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer’s complaint by the committee is free of charge. <\/p>
